Everyone knows what a circus it would be to try and find an unbiased jury, so it's pretty clear the trial was more about agenda than justice.  George Floyd not only was a criminal who has now become a martyr for the cause, but also a pawn for the cause. 

A juror in the Derek Chauvin trial may have jeopardized the guilty verdict by attending a rally last year and wearing a “Get Your Knee Off Our Necks/BLM” T-shirt, raising questions about whether he told the truth during jury selection.

Brandon Mitchell, known as Juror #52, told Minneapolis news outlets Monday that he attended the Aug. 28 march in Washington, D.C., featuring speeches by George Floyd’s siblings, while a photo circulating online shows him with two cousins wearing the T-shirt as well as a “Black Lives Matter” hat.

What may come back to haunt the prosecution is that Mr. Mitchell, 31, answered “no” when asked during jury selection if he had attended any protests for George Floyd.

Mitchell told Nelson during jury selection that he had a “very favorable” opinion of Black Lives Matter, that he knew some police officers at his gym who are “great guys,” and that he felt neutral about Blue Lives Matter, a pro-police group. He also said he had watched clips of bystander video of Floyd being pinned and had wondered why three other officers at the scene didn’t intervene.

He said he could be neutral at trial.

Mitchell told the Star Tribune that last summer’s protest was “100% not” a march for Floyd.

“It was directly related to MLK’s March on Washington from the ’60s … The date of the March on Washington is the date … It was literally called the anniversary of the March on Washington,” he said.

and you don't think Chauvin's lawyers could use it as a reason to get a new trial or have his conviction thrown out?

And parsing fact by saying the protest was not 100% about Floyd is laughable.

The defense attorney for former police officer Derek Chauvin filed a motion for a new trial on Tuesday.

Attorney Eric Nelson filed the request (pdf (https://www.mncourts.gov/mncourtsgov/media/High-Profile-Cases/27-CR-20-12646/Notice-of-Motion-and-Motion.pdf)) to a Minnesota court arguing that a new trial should be granted in the interest of justice and because an abuse of discretion had deprived Chauvin of a fair trial. He also contends that Chauvin’s conviction was tainted by prosecutorial and jury misconduct, errors of law at trial, and that the verdict was contrary to law.

Chauvin was convicted last month in the 2020 death of George Floyd, who stopped breathing while being pinned to the ground by Chauvin following an arrest. Floyd was suspected of using counterfeit money in a Minneapolis store. A jury convicted Chauvin of second-degree murder, third-degree murder, and second-degree manslaughter.

In support of his request, Nelson alleged a number of issues that he said would have affected the outcome of Chauvin’s trial including the refusal to move the trial over concerns of a tainted jury pool or failing to sequester the jury. He also argued that Judge Peter Cahill abused his discretion when he rejected a separate motion for a new trial over concerns that the publicity during the case could have affected the juror’s judgement.

“The publicity here was so pervasive and so prejudicial before and during this trial that it amounted to a structural defect in the proceedings,” Nelson wrote.

Other issues include alleged errors by the judge throughout the trial such as when Cahill submitted instructions to the jury that failed to “accurately reflect the law with respect to second-degree unintentional murder, third-degree murder, and authorized use of force.”

He also alleged that the prosecutors had committed misconduct including disparaging the Defense, improper vouching, and failing to adequately prepare its witnesses.

“The cumulative effect of the multiple errors in these proceedings deprived Mr. Chauvin of a fair trial, in violation of his constitutional rights,” he said.

Nelson is asking the court to order a hearing to impeach the verdict on the grounds that the jury “committed misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and/or failed to adhere to instructions during deliberations, in violation of Mr. Chauvin’s constitutional rights to due process and a fair trial.”

Chauvin is going to get a New Trial and BLM will blame it on White Systemic Racism.  Something that is a purposeful fabrication to continue their  other purposeful fabrication of victimhood.

He won't get a new trial jimmy boy.    He's not shown any grounds for any appeals.  He's serving his jail time and that's where he will stay. 



Following his conviction, Chauvin's bail was revoked and he was remanded into custody by the Hennepin County Sheriff's Office, which transferred him to the Minnesota Department of Corrections. He was then booked into the Oak Park Heights maximum-security state prison, where he was previously incarcerated following his 2020 arrest. Chauvin is held in solitary confinement for 23 hours a day in an isolated wing of the prison, where he is under constant watch "for fears for his safety." Chauvin will be held at Oak Park Heights until his sentencing hearing on June 25, 2021.
