A controversial provision in recently released EPA regulations limiting and taxing methane emissions that imposes penalties on certain food products has been ruled Constitutional by a Federal court in Oregon.

The regulation imposes a fee on farmers, manufacturers and retailers who produce or sell methane-heavy products such as canned beans, canned chili with beans and fresh cucumbers that critics say will add an average of $50-$100 to food costs per family per year when the regulation goes into effect in November this year, shortly after the mid-term elections.

"Evidence presented to this Court shows that methane emissions caused by widespread consumption of these products present a clear and present danger to the environment and adds to global warming. The 1% surcharge imposed on producers and distributors of these products is hereby ruled a reasonable impediment to such production and distribution that will raise funds for the EPA's Congressionally-mandated operations without interferring in the rights of consumers of these proucts." said Judge Miriam Westover of the 8th Circuit Court on Friday.
