TAMPA - Eric Canonico says he was scared when he pointed a gun at three Plant High School students he thought had come to his family home to attack his fiancee's son.


He needed to protect the teen for whom he'd become a father figure and make sure nothing bad happened to his fiancee or the family's two younger children, he said.


He says he fired the gun into the ground only when one of the students refused to listen to his commands and charged him.
He needed to keep control of the situation, he says, until police arrived.


However, Canonico, 42, found himself in handcuffs and is now facing prosecution on charges of armed false imprisonment, discharging a firearm in public and aggravated assault with a deadly weapon.


His attorney says the case is tailor-made for the state's "Stand your ground" law. It also was a law the attorney helped pass.


State Rep. Kevin Ambler, one of the law's co-sponsors, told Hillsborough Circuit Judge Ronald Ficarrotta this was the kind of case for which the law was designed.

So in your opinion it would have been better to let the assault take place?
 
He should have let his son be attacked by a group of cowards?
 
He shot no one!
 
He assaulted no one!
 
All he did was diffuse a dangerous situation!

that you misunderstand d2d is no suprise.
 
 
Firing a deadly weapon ...into the ground, floor or whatever, in the general direction of for the sake of frighteneing someone...is considered assult with a deadly weapon in most communities.
 
Regardless the circumstances, the intent of the action was clear.
 
 
why would you want to defend someone violating the law?

There is nothing illegal about stopping an attack which the man did by discharging his weapon into the ground!
 
Were there things he could have done better?  Sure!
 
The fact remains he stopped a gang attack upon an individual!
 
You and the police in this case apparently think he should not have interfered in the attack!

well THAT is the jist of the story.
 
There's a conflict between illegal activity - assault with a deadly weapon - as defined by law enforcement...
 
and this recently enacted law, that seems to give people the right to make a mistake.
