Lose your FOID, give up your guns: Making a sound policy work

Anyone who wants to purchase a gun or ammunition has to get a firearm owner’s identification card, which means passing a background check. Among those barred: felons, drug users, undocumented immigrants, fugitives and those who have been institutionalized for the treatment of mental illness or convicted of domestic violence offenses. Anyone rejected for a FOID card is not allowed to have guns. It’s a good system.

A FOID card is automatically revoked if the holder no longer meets the requirements for getting one — say, by getting convicted of a felony. Those whose cards are canceled are notified by mail that they must surrender their cards and divest themselves of their weapons within 48 hours. In practice, things don’t always go as they’re supposed to.

Last year, the state revoked 10,818 FOID cards. But only 1 in 4 of the people who lost their right to have guns actually submitted a firearm disposition record, as the law mandates. Only 10 were arrested for ignoring their obligations.

The dangers posed by such lax enforcement are grave. The mass shooting at a factory in Aurora last month was carried out by a man who should not have been given a FOID card and whose card was revoked after his felony record came to light. But he kept the gun that he used to kill five people and wound six.
