The 4th Circuit Court of Appeal's opinion hinged on whether the weapons covered by Maryland's assault weapon ban fit the description of those proscribed by Scalia in his DC v. Heller decision. By a 10-4 margin, the appeals court found that, within the context of Scalia's interpretation of the Second Amendment, assault weapons are not protected by the Second Amendment.

The state recognized that the Supreme Court’s decision in D.C. v. Heller protects citizens’ right to keep handguns in the home. But it argued that the firearms it had proscribed constituted “dangerous and unusual weapons,” which the Heller court said could be outlawed. Indeed, Maryland pointed out, the Heller court explicitly declares that especially dangerous weapons “that are most useful in military service—M-16 rifles and the like—may be banned.”

Liberals identify weapons by how they look because they lack the intelligence to actually understand functionality, I will say it again, in a crowded theater of mall you can do far more damage much quicker with a semi-auto 12 gauge, no aiming required and you expend a 100-200 bullets each time you squeeze the trigger, your head can be severed with ONE SHOT from a 12 gauge, you cannot do that with the scary "assault" rifle.
