Actually, students have never had freedom of speech.  Or teachers.  Or principals.  Or employees at work.  All can be judged and disciplined for anything they say, any action they take, either at school, on the job, or at home if it gets back to people in authority over them. 

DETROIT — More than 100 people lined the road in front of Marian High School in Bloomfield Hills on Sunday morning to support a teacher fired, she says, because she's a gay and expecting a baby with her partner.

Amanda Ruud McVety, a 2002 Marian graduate who organized the gathering, said the firing of former chemistry teacher Barbara Webb goes against the social-justice teachings instilled in Marian students.

"We value human diversity," McVety, 29, of Birmingham said of those gathered at the school. "It's time to show that — through actions and through words. It's time we look at (homosexuals) as equals and not shame them for who they are."

Webb, 33, taught chemistry for nine years and coached sports at the Catholic, all-girl high school until she was fired last month. She took to Facebook to announce her dismissal, urging people to stand up for change. The post was shared more than 1,000 times and support has swelled for the teacher. McVety started the Facebook page, "I Stand With Barb Webb,"which had more than 3,300 members as of Sunday afternoon. A petition on change.org also asks for Marian administration to support LGBT students and staff.

I bet the district gives up and settles out of court!

Freedom of speech is the right to communicate one's opinions and ideas without fear of government retaliation or censorship. The term freedom of expression is sometimes used synonymously, but includes any act of seeking, receiving and imparting information or ideas, regardless of the medium used.

Governments restrict speech with varying limitations. Common limitations on speech relate to libel, slander, obscenity, pornography, sedition, incitement, fighting words, classified information, copyright violation, trade secrets, non-disclosure agreements, right to privacy, right to be forgotten, public security, public order, public nuisance, campaign finance reform and oppression.

Whether these limitations can be justified under the harm principle depends upon whether influencing a third party's opinions or actions adversely to the second party constitutes such harm or not. Governmental and other compulsory organizations often have policies restricting the freedom of speech for political reasons, for example, speech codes at state schools.



Relationship to other rights

The right to freedom of speech and expression is closely related to other rights, and may be limited when conflicting with other rights (see Limitations on freedom of speech).

The right to freedom of expression is also related to the right to a fair trial and court proceeding which may limit access to the search for information or determine the opportunity and means in which freedom of expression is manifested within court proceedings.

As a general principle freedom of expression may not limit the right to privacy, as well as the honor and reputation of others. However greater latitude is given when criticism of public figures is involved.

so, it's not a violation of the 1st Amendment.
