One thousand of the 36,000 illegal immigrant criminals the government released in 2013 have gone on to commit other crimes, including child sex abuse, hit-and-run and child cruelty, according to new data released Friday evening by Senate Judiciary Committee Chairman Charles E. Grassley.


The information, which the Homeland Security Department provided toMr. Grassley, details all 1,000 convictions including dozens of drunk-driving convictions, drug offenses and weapons convictions. But the more serious crimes include domestic abuse, carjacking and aggravated assault.
One of the illegal immigrants, identified as No. 960, was subsequently convicted of inflicting injury on a domestic partner; child cruelty, with the possibility of injury or death; probation violations; speeding; driving without a license; and failing to appear for court.

Beefed-up enforcement at the U.S.-Mexico border since Sept. 11, 2001, has substantially increased the number of arrests of illegal immigrants, but tens of thousands of captured non-Mexicans continue to be released into the United States because there is no place to hold them, according to experts and immigration officials.

The vast majority simply slip away inside the country after being issued "Notices to Appear" for a deportation hearing -- documents known to Border Patrol agents as "Notices to Disappear." The success of border crossers who stay in the United States through this "catch-and-release" process has encouraged others who hope to enter the country the same way.

In a dozen speeches since October, President Bush has vowed to replace catch-and-release with the "catch-and-return" of 150,000 "other than Mexican" (OTM) immigrants arrested each year. The goal is to deny court hearings to all but asylum-seekers, speed deportations and make the most of limited detention space in jails, prisons and immigration centers.

But as Washington debates the overhaul of the nation's immigration laws and Bush prepares to address the nation tomorrow on border protection, the persistent catch-and-release problem is a reminder of costly and unintended consequences of past enforcement efforts.

Even if authorities overcome operational and legal hurdles to curb the flow of people from El Salvador, Honduras, Guatemala and other countries, experts say they will be addressing only a tiny sliver of the illegal immigration problem. The U.S. Border Patrol arrested nearly 1.2 million people last year -- the vast majority of them Mexicans who were promptly returned across the border -- and estimates that 500,000 others evaded capture.

Since the founding of the Department of Homeland Security, which sought to deter illegal crossings with a show of force, arrests of non-Mexican border crossers have tripled, from 49,545 in 2003 to 155,000 in 2005. But presidents and Congress for 20 years have not shown corresponding support for detention beds, courts, inland enforcement or diplomatic and administrative changes.

As a result, the spike in arrests backfired, because there was no place to put the tens of thousands of new detainees. Overwhelmed immigration courts have been unable to keep up.

Nor could the Border Patrol immediately send non-Mexicans back to Mexico, which does not accept other countries' nationals, forcing the agency to house them at an annual cost of $35,000 per bed.

Beset by start-up and coordination problems in the new Homeland Security Department, ICE faced a $500 million budget deficit in 2004, leaving a fourth of its detention jobs unfilled. As arrests climbed last year, Border Patrol agents released 70 percent of non-Mexicans into the United States. Of those released and later ordered to leave the country, only 18 percent do.

Word soon spread to smugglers and illegal immigrants, who rushed in to learn whether finding work in the United States meant only a short detention at the border.

Federal statistics show the result, which has enraged border communities. Once arrested and released, the number of illegal immigrants who failed to appear in court more than tripled from 29,550 in 2003 to 97,868 in 2005, or 60 percent of cases, up from 32 percent.

On Univision’s talk show Al Punto, a Spanish-language political talk show, host Jorge Ramos interviewed a political activist on March 9, 2014, about her choice to use that nickname in a recent speech.

"The truth is we’re at the point of reaching 2 million deportations," said Janet Murguía, National Council of La Raza president, in an interview PolitiFact translated from Spanish. "For us, this is a historic level, more than any other president of the United States. Our community is in crisis, and this isn’t acceptable."

PolitiFact has looked into deportation statistics under the Obama administration, but not since he’s started his second term. Let’s see how deportations under Obama compare to those under previous presidents.

Laura Vazquez, a senior immigration legislative analyst at La Raza, told us that Murguía was referring to deportation numbers from the Department of Homeland Security’s Immigration and Customs Enforcement (ICE).

ICE publishes yearly immigration statistics. However, ICE numbers lump together two separate statistics: removals and returns. Removals are formal orders to leave the country issued by a judge. A return is a more desirable option for Mexican nationals that allows them to leave the country without a restriction on when they can re-enter with a visa. There aren’t formal consequences attached with returns, and returns technically don’t count as "deportations,"according to Homeland Security themselves.

Media outlets routinely cite ICE numbers. Here, we chose not to. Those numbers aren’t an accurate count of deportations, because they include returns. Also, ICE numbers don’t include deportations conducted by Border Patrol officers. So when we hear the word "deportations," the public’s definition doesn’t line up with how ICE defines the action.

Instead, we elected to reference the other common source for deportation numbers, Homeland Security’s Yearbook of Immigration Statistics. Here, we can count all the removals by fiscal year. This isn’t a perfect assessment, because presidents’ terms don’t start on the same day new fiscal years do. We only have access to this data through fiscal year 2012, so we can’t track Obama’s most recent deportations.

Here, we’ll take a closer look at deportations under Obama and other recent presidents. Deportations ramped up starting during the Clinton years.

On average, Obama is outpacing Bush by year. But since Obama hasn’t yet served two full terms, Bush has still overseen more deportations than any other president. Because ICE data is a year ahead of this chart, we can see how Murguía pegged Obama’s deportations at closer to 2 million.

The most recent spike in deportations started at the end of the George W. Bush administration, said Pew Research Center associate Ana Gonzalez Barrera. In 2007, Bush increased the consequences for people illegally crossing the border, a strategy Obama has continued so far.

Our ruling

Murguía defended her "deporter-in-chief" nickname for Obama by saying he’s deported more people than any other president. Her office pointed to a set of statistics that counts departures in a different way than what most people would think of as deportations. We looked at statistics that used more a literal definition of deportation. By that standard, Obama is on track to outpace Bush by the end of his term, but he’s not quite there yet, according to Homeland Security data. At nearly 1.6 million deportations, that's still some distance from "approaching 2 million."

It’s too soon to say that Obama has deported more people than any other president. But with the information available, it looks like he’s on track to do so. We rate her claim Half True.

Jeh Johnson acknowledged Tuesday that his department’s deportation numbers are now mostly made up of illegal immigrants caught at the border, not just those from the interior, which means they can’t be compared one-to-one with deportations under President Bush or other prior administrations.

The administration has argued it is tougher on illegal immigration than previous presidents, and immigrant-rights groups have excoriated President Obama, calling him the “deporter-in-chief” for having kicked out nearly 2 million immigrants during his five-year tenure.

But Republican critics have argued those deportation numbers are artificially inflated because more than half of those being deported were new arrivals, caught at the border by the U.S. Border Patrol. Previous administrations primarily counted only those caught in the interior of the U.S. by U.S. Immigration and Customs Enforcement.

“Under the Obama administration, more than half of those removals that were attributed to ICE are actually a result of Border Patrol arrests that wouldn’t have been counted in prior administrations,” said Rep. John Culberson, Texas Republican.

“Correct,” Mr. Johnson confirmed.

That would mean that in a one-to-one comparison with the final years of the Bush administration, deportations of those same people under Mr. Obama had actually fallen, according to immigration analysts who have studied the data.

Under Title 8 Section 1325 of the U.S. Code, "Improper Entry by Alien," any citizen of any country other than the United States who:
  • Enters or attempts to enter the United States at any time  or place other than as designated by immigration officers; or
  • Eludes examination or inspection by immigration officers;  or
  • Attempts to enter or obtains entry to the United States by  a willfully false or misleading representation or the willful  concealment of a material fact; 
has committed a federal crime.


Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretion of immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.

Apologists for illegal immigration like to paint it as a victimless crime.  But in fact, illegal immigration causes substantial harm to American citizens and legal immigrants, particularly those in the most vulnerable sectors of our population--the poor, minorities, and children.

We need a comprehensive program to end illegal immigration; that means ensuring that people who enter illegally or overstay their lawful status will not be able to obtain employment, public assistance benefits, public education, public housing, or any other taxpayer-funded benefit without detection.

The three major components of immigration control--deterrence, apprehension and removal--need to be strengthened by Congress and the Executive Branch if effective control is ever to be reestablished.

Obama can not unilaterally change immigration law, that is a Constitutional authority given only to the Congress....

His piece of shit nominee for AG could not even answer the simple question put forth to her in testimony the other day....

Rep. Martha Roby filed a bill, the "Prevention of Executive Amnesty Act of 2015," to block President Obama's unilateral action on immigration. Now, another House Republican has filed another proposal — this one more far-reaching — that would stop the president's plan to offer quasi-legal status to millions of illegal immigrants.

The new bill, the "Repeal Executive Amnesty Act of 2015," is from Rep. Robert Aderholt.

The 44-page measure "not only defunds the president's actions towards amnesty but also removes the president's discretion in the ability to grant work permits, Social Security, and other federal benefits that go along with his order," Aderholt said in a press release Wednesday. In addition, the proposal will "put limits on the president's future ability to enact such wide-reaching actions that circumvent the Constitution's separation of powers," Aderholt said.

Beyond that, the bill would put pressure on state and local governments to cooperate with Immigration and Customs Enforcement in detaining illegal immigrants. It would also restore the "Secure Communities" enforcement program that Obama ended.

Finally, the bill would amend the 2008 law known as the William Wilberforce Trafficking Victims Protection Reauthorization Act, which allowed the relatively quick return of unaccompanied minors who enter the United States illegally from Canada or Mexico, but set up elaborate and lengthy procedures for children who come to the U.S. from non-contiguous countries. (Almost none of the children and adults who surged across the U.S. border illegally from Guatemala, Honduras, and El Salvador last summer have been returned.) Under the Aderholt bill, they could be sent back to their home countries more quickly.

The Aderholt and Roby bills present the House Republican leadership with a choice. Should the GOP propose a limited, specific measure to rescind only the president's action of last November? Or should it do that and in addition undo more of the damage the president has done to immigration enforcement during his six years in office?
